Mediation is a process where parties and their attorneys work with a neutral third party, a mediator, to reach a settlement and avoid the costs and uncertainties of obtaining a result from a trial. All contested litigation in SC requires the parties to use mediation and attempt to settle the case to within 365 days of filing. Failing to conduct mediation can result in your case being dismissed.
Mediation is an opportunity for you to work with your attorney and the mediator to have meaningful input into any final decision. If successful a mediated settlement produces a result that is tailor made to bring a solution that meets your individual needs. The alternative is placing your future in someone else's hands that may or may not make a decision that is best for you.
